Call Their Customer Service Line and File a Complaint
You absolutely should file a complaint. Not only should you file a complaint, but you should request a copy of the complaint report in writing. Customer service departments are required to file your complaint and give you a copy upon request. Ask the representative what the company intends to do about the issue. Record what is said, either in writing or through a recording app on your phone. Give the company a week to respond as promised.
No Response/Refusing to Address the Issue
When the company does not respond to the issue, and you have received a copy of the complaint, call again. If there is still no response, take your copy of the complaint to a civil litigation lawyer. Hire that lawyer to represent you. He or she will look at your evidence and complaint to determine what compensation you are entitled to, and then file a lawsuit against the company. An alternative option is to have your lawyer send the company a threatening letter that stipulates why you are considering a lawsuit against the company and your expected actions on their part in response to you. This may or may not work, so be prepared to proceed with the lawsuit.
Proceed with the Lawsuit
It is uncommon for a company to continue refusing responding to a product issue and claim, but it can happen. The company you are suing has up until the day before the hearing to decide if they are going to respond and settle out of court, which they can do.
